South African legislators propose draft rules for cross-border crypto transactions

According to CoinMeta, South Africa's Ministry of Finance and Central Bank are advancing regulations on cross-border cryptocurrency transactions. A draft set of rules released on Monday suggests that the sending of cryptocurrencies overseas must be conducted through authorized providers and reported to the Central Bank's financial monitoring department (Finsurv). In a joint statement, the Ministry of Finance and Central Bank stated that the proposed regulatory measures aim to reduce the risk of regulatory arbitrage by regulated entities in cross-border activities and to enhance the financial monitoring department's ability to detect, deter, and combat illegal financial flows. This framework will not make cryptocurrencies legal tender, nor will it differentiate between different digital assets. The two institutions have invited stakeholders to submit their opinions, with a deadline of September 30th. These rules are based on a draft issued by the Ministry of Finance in April, which required cryptocurrency holders to declare assets exceeding a certain threshold and to hand over their private keys upon request by law enforcement authorities. South Africa's push for cryptocurrency regulation comes against the backdrop of a global shift towards enforceable cross-border frameworks. Authorities around the world are being called upon to protect consumers and maintain financial systems while supporting innovation, leading to a patchwork of global policies.
