Illinois crypto organization files lawsuit against new digital asset tax

According to CoinMeta, the Illinois Blockchain Association and the Crypto Innovation Commission filed a lawsuit against the state of Illinois on August 21, seeking to block a 0.2% digital asset tax that was set to take effect on January 1, 2027. The lawsuit was filed in the Seventh Judicial Circuit Court of Sangamon County, targeting Illinois State Tax Commissioner David Harris, Attorney General Kwame Rawul, and Sangamon County State's Attorney John Milhizer. This case is the second industry lawsuit regarding Illinois' crypto tax. The complaint alleges that the tax violates the federal Internet Tax Freedom Act, arguing that digital asset activities are not treated equally with traditional financial transactions. The plaintiffs seek a court ruling to declare the digital asset tax law invalid and request a preliminary and permanent injunction to prevent Illinois officials from implementing or enforcing the legislation.
