According to CoinMeta, the XRP CLARITY legislation is intertwined with the efforts of the U.S. Securities and Exchange Commission (SEC) to promote the integration of the crypto market. Nate Geraci indicates that the crypto debate in Washington is no longer about whether digital assets will enter traditional finance, but rather how they will do so. The regulatory debate is shifting from securities litigation to how the CLARITY legislation and SEC rules will integrate crypto into the U.S. financial market. This legislation faces a key procedural vote in the Senate on September 15th, while federal regulators continue to advance crypto-related rules while awaiting Congress. Ripple and SEC both withdrew their appeals in August 2025, upholding the final judgments of the district courts. Judge Analisa Torres determined that the procedural XRP sales in Ripple did not constitute the issuance of unregistered securities, whereas certain institutional sales did. The CLARITY legislation could shift the entire industry from case-by-case litigation to a statutory market structure. The framework established by the Senate Banking Committee creates a "subordinate asset" system that treats eligible network tokens as commodities and provides tailored disclosure and fundraising rules, rather than automatically incorporating each token transaction into the full securities framework.
