The latest guidelines released by SEC clarify that crypto projects can continue to develop, maintain, and improve their functions after they are launched, without having to worry about violating the relevant regulations of Howey testing. According to FAQ issued on September 25th, developers can continue to provide security guarantees, financial support, and expand network effects for crypto networks that are functioning normally, without it constituting "essential management efforts." In addition, the regulations regarding token repurchases have also been clarified; the repurchase of crypto assets that are functioning normally will not be considered as a commitment to make essential management efforts. These guidelines provide greater flexibility for crypto projects in terms of marketing and function promotion, allowing for the use of vague and aspirational language in communications, as long as no direct promises of profits are made.
