The experiment, known as Crypto Asset Regulation, saw the release of related proposed rules on August 18, 2026, with the aim of providing a clear regulatory path for digital assets. The proposals included two exemption clauses: a startup window of $5 million and a continuous exemption of $75 million. They also included a conditional safe harbor for Howey tests. With Peirce's departure, SEC is now down to just two commissioners, facing the challenge of reaching a consensus before the end of the comment period.
