CFTC: The US CFTC grants passive encryption wallets exemption from broker registration

According to CoinMeta, the U.S. Commodity Futures Trading Commission (CFTC) issued a statement on September 17th that provides eligible passive software providers with broader avenues to avoid certain crypto broker registration requirements under specific conditions. The statement indicates that the CFTC's Market Participants Division will not recommend that certain crypto broker registration requirements be applied to eligible providers. This exemption covers software that facilitates user transactions with regulated futures intermediaries and designated contract markets. This development expands on the previous guidelines for self-hosted wallet software established by the CFTC. Meanwhile, on the same day, the Securities and Exchange Commission (SEC) also issued temporary exemptions for certain tokenized stock trading platforms. Both actions were taken after the Senate failed to advance legislation on the structure of the federal digital asset market. The CFTC's Market Participants Division stated that the new policy broadly applies to passive software providers, but providers must meet the conditions specified in the staff letter.
