The Bitcoin Policy Institute points out that a recently revived proposal by the SEC could exclude companies that hold digital assets, affecting trillions of dollars in US retirement savings. Others believe that the SEC is abusing its power with these exclusion strategies, targeting companies with other types of assets as well. A report from the Bitcoin Policy Institute raises doubts about the SEC's neutrality, accusing it of making proactive decisions in past proposals. The institute calls on Congress to review these exclusion practices and proposes assumptions for including legally sound, highly liquid stocks in broader market benchmarks. It is noted that the comment period ended on September 30, with results expected to be announced before October 16; any changes will be taken into account in the index review in November 2026.
