Kalshi Wins Preliminary Injunction in Illinois; Sports Contracts May Be Subject to Federal Regulatory Swap

According to CoinMeta, the prediction market platform Kalshi has won a partial preliminary injunction in a lawsuit in Illinois. The court ruled that sports championship contracts may fall under the jurisdiction of federal regulations regarding swaps. Judge Martha M of the Northern District Court of the Federal Circuit in Illinois ruled that the state's sports betting licensing system and related criminal provisions may be overridden by federal law, and therefore cannot be enforced against Kalshi for the time being. The court did not make a ruling regarding the new fee imposed by Illinois on prediction markets, which stipulates a 1.75% fee for the first 5 million related transactions, 3.5% thereafter, plus an additional 15% of total revenue, and a fee of 25 or 50 cents per transaction. The court requested all parties to submit further opinions regarding these fees.
