NFL Supports States in Their Confrontation with Kalshi; Supreme Court Predicts a Market Battle

According to CoinMeta, NFL has taken a stance in the dispute over the sports betting market between Kalshi. In a brief filed with the court on Thursday, NFL urged the Supreme Court to accept the appeal from New Jersey against the ruling of the Third Circuit Court. The ruling stated that Kalshi's sports event contracts fall under the exclusive jurisdiction of CFTC and therefore are not subject to state gambling laws. NFL supported the rulings of the Sixth and Ninth Circuit Courts in the brief, arguing that the definition of swaps in the Dodd-Frank legislation covers hedging tools for existing risks, rather than bets that create new risks, which means that sports contracts should be subject to state gambling regulations. NFL stated that if the Supreme Court supports the ruling of the Third Circuit Court, they will redouble their efforts to persuade CFTC, operators, and Congress to adopt stronger measures for integrity and consumer protection before then.
