Multiple organizations join forces to oppose the Illinois crypto tax, which had previously been postponed for 6 months

Although Illinois officials have agreed to postpone the implementation of a 0.2% tax rate on crypto assets, organizations with a pro-industry stance are still pushing for a summary judgment from the court on the substantive issues of the case.

The Innovation Crypto Committee ( Crypto Council for Innovation , CCI ) and the Blockchain Association ( Blockchain Association , BA ) have stated that they will join forces with the Digital Chamber of Commerce ( Digital Chamber ) and other organizations to promote court proceedings regarding a substantive issue concerning Illinois' digital asset tax. This tax was originally scheduled to take effect in 2027.

According to a document submitted on Tuesday to the Sangamon County Circuit Court, these crypto advocacy organizations are requesting the court to approve an accelerated summary judgment schedule in order to “make a ruling on the legality of this tax as soon as possible.” The document mentions lawsuits filed by CCI and BA against Illinois officials, as well as another lawsuit filed by the Digital Chamber of Commerce and the Illinois Blockchain Association.

CCI CEO Ji Kim stated: "Although suspending the implementation of the Digital Assets Tax Law can protect Illinois consumers and businesses from this burdensome and legally flawed tax until July 1st, it is still crucial to resolve the substantive issues of the case as soon as possible."

Earlier this month, officials in Illinois agreed to postpone the implementation of this 0.2% crypto tax law by six months, from January 1, 2027, to July 1, 2027. As part of a lawsuit filed by the Digital Commerce Chamber, this decision is a response to claims that the digital asset tax was “imposed on the state budget” without debate or public feedback. Cody Carbone, the CEO of the Digital Commerce Chamber, stated that the organization will continue to pursue legal proceedings “until this tax is completely overturned.”

If the court approves an accelerated schedule, a ruling on the substantive issues of the law could possibly be made as early as March.

There have been leadership changes within the Blockchain Association this week.

According to the arrangement, Summer Mersinger will resign from her position as CEO of the Blockchain Association on Friday, as part of a leadership transition. Mersinger joined this advocacy organization last year, after having previously left the Commodity Futures Trading Commission of the United States (CFTC).

The former CEO of the organization, Kristin Smith, will serve as the interim leader, however it is expected that Mersinger will remain in position until the end of 2026.
