Market participants have expressed their opinions on the proposed crypto regulatory rules by the U.S. Securities and Exchange Commission (SEC).
This financial regulatory agency has scheduled to conclude its public opinion solicitation regarding “Regulation Crypto Assets” which was initiated in August. Previously, the U.S. Congress failed to pass legislation that could have established a framework for cryptocurrency regulation at the level of this agency and other government departments.
On Tuesday, SEC will conclude the public consultation period for “Regulation Crypto Assets”. This set of rules was proposed in August with the aim of establishing what SEC refers to as a “clear and applicable framework for specific crypto asset investment contracts”. During the 60-day consultation period, SEC received approximately 140 comments from interest groups and individuals, covering rules and regulations related to the proposed safe harbor; this safe harbor will prevent token issuers from being considered “investment contracts”, as well as exemption clauses for companies with issuance amounts reaching a certain threshold.
The " Markets in Crypto Assets ( MiCA ) Crypto Alliance ", established to assist in the organization and implementation of the EU's digital assets framework, generally supports the proposed amendments to the disclosure requirements made by SEC. The alliance recommends specific revisions in order for SEC to better define 'concepts and data structures unique to crypto assets, as well as disclosure requirements'.
Other individuals, including the founder SkyBridge Capital and Anthony Scaramucci, also stated that they support the encryption regulations proposed by SEC. Scaramucci claimed that these digital asset regulations represent a "organic adoption" and "represent the committee returning to its proper role," but he did not mention the inaction of Congress regarding the Digital Asset Markets Clearing Act (Digital Asset Market Clarity, CLARITY Act). Additionally, six other people submitted their opinions anonymously.
Despite many public opinions praising the efforts of SEC to promote crypto regulation or expressing willingness for further discussion, some legal experts believe that these regulations may be more susceptible to overturnment than the bills passed by Congress. The two financial institutions responsible for regulating parts of the crypto industry – SEC and the Commodity Futures Trading Commission (CFTC) – still face staffing shortages at the leadership level.
